Jackson Death Trial, Day 12: Defense Changes Claim

Lawyers for Dr. Conrad Murray, accused of involuntary manslaughter in the death of Michael Jackson, are abandoning the argument that the singer accidentally killed himself by orally ingesting propofol, reports TMZ. Defense attorney J. Michael Flanagan said in court Wednesday that an independent study by the defense showed swallowing propofol would not produce fatal results.

The defense said it will continue the argument that the King of Pop self-injected the drug after awakening and becoming frustrated by his lack of sleep. Murray, who was bombarded by paparazzi last week, spoke out about his defense team when someone asked, "You think they're doing a good job?" The doc replied, "I think so." As the prosecution winds down their case, new testimony was also heard from cardiologist Dr. Alon Steinberg, who explained how Murray deviated from general standards in his treatment of Jackson. Famed jazz drummer Freddie Gruber -- who taught and influenced a generation of rock drummers -- died Oct. 11 in Los Angeles after a lengthy illness. He was 84.

According to DrummerWorld, Gruber got his start in New York during the be-bop era, performing with the late Charlie Parker and became a roommate and longtime friend of drumming legend Buddy Rich.

Gruber was also responsible for helping Rush drummer Neil Peart "reinvent" his style in the 1990s. "He was easy you know because he wasn't nuts," Gruber said of meeting Peart in a clip from the band's 2010 documentary 'Rush: Beyond the Lighted Stage.' "It was fun. We didn't have to go to some strange land."

Boardwalk Empire Renewed for Season 3 on HBO

Boardwalk Empire is renewed for Season 3 by HBO

Following resounding critical approval for the series' second-season debut on Sept. 25, HBO has renewed Boardwalk Empire for a third season, it was announced today by Michael Lombardo, president, HBO Programming.

"Following a triumphant first season, I was eager to see what Terence Winter, Martin Scorsese and the rest of their stellar team had in store, and they continue to surpass our highest expectations," said Lombardo. "The response from the media and our viewers has been extremely gratifying."

From Terence Winter, Emmy Award-winning writer of The Sopranos and Academy Award-winning director Martin Scorsese, Boardwalk Empire is set in the 1920s in the early days of Prohibition, and chronicles the life and times of Enoch "Nucky" Thompson, the undisputed leader of Atlantic City, who was equal parts politician and gangster.

The renewal of Boardwalk Empire is the latest in a number of recent drama series pickups, following True Blood, Game of Thrones and Treme, as well as commitments to the new series Luck, Veep, Girls, Life's Too Short and the Untitled Aaron Sorkin Project.

Among the early critical raves for the new season of Boardwalk Empire, New York's Daily News called the show "delicious entertainment" and "one of the best shows on television," while Daily Variety termed it "consistently bold and lusty," as well as "good to the last illicit, intoxicating drop." The Boston Globe hailed Boardwalk Empire as "a must-see show" and "remarkable," and Entertainment Weekly noted that "drama this good should be illegal."

Boardwalk Empire ranks among HBO's most popular series with an average gross audience of 10.7 million viewers.

At the recent Primetime Emmy Awards, Boardwalk Empire led all programming with eight awards, including Outstanding Directing for a Drama Series (Martin Scorsese).

In Jan. 2011, Boardwalk Empire received two Golden Globe Awards, for Best Television Series - Drama and Best Performance by an Actor in a Television Series - Drama (Steve Buscemi)

The series also received two Screen Actors Guild awards, for Outstanding Performance by an Ensemble in a Drama Series and Outstanding Performance by a Male Actor in a Drama Series (Steve Buscemi).

The Avengers Gives Paramount Sole Marketing Placement

Disney's logo will be absent from The Avengers' marketing materials

Yesterday Marvel Studios released the first full trailer for The Avengers, which is the first movie to be released by Walt Disney Studios under the deal between Marvel Studios, Disney, and Paramount Pictures. Curiously, Disney's logo was nowhere to be seen on the trailer, and any of the other marketing materials for The Avengers so far, which is due to a unique clause Paramount put in the contract giving the studio prominent marketing placement.

The deal, signed nearly a year ago, gave Disney theatrical distribution rights and marketing rights to The Avengers, although it is said Disney wants the Marvel logo to be featured instead of their own logo. So, even though Paramount Pictures isn't marketing or distributing The Avengers in any way, their logo will still be featured on the trailers and posters leading up to the May 4, 2012 release. While Disney will be reaping the benefits of The Avengers, many may think it is actually Paramount distributing the superhero adventure.

Paramount received $115 million for the transfer of worldwide distribution and marketing rights for The Avengers and Iron Man 3 as a minimum guarantee. Paramount actually will receive 9% of the theatrical gross receipts for both The Avengers and Iron Man 3, so it will likely earn much more than that initial figure if both movies are successful. Paramount also owns the pay TV rights to The Avengers through its Epix brand.

The Avengers comes to theaters May 4th, 2012 and stars Chris Hemsworth, Scarlett Johansson, Chris Evans, Jeremy Renner, Robert Downey Jr., Cobie Smulders, Tom Hiddleston, Samuel L. Jackson. The film is directed by Joss Whedon.

Phillips on What's Next After 'Dancing': 'Um... Sex?'

Chynna Phillips said farewell after her elimination on Tuesday's "Dancing with the Stars," but the "Hold On" singer didn't let it get her down.



When asked by a paparazzo what she plans to do next, Phillips replied, "Um... well, I guess..." before she was interrupted by husband Billy Baldwin, who said, "Don't answer that." Phillips turned to Baldwin and asked, "Why? Sex?"

With a smile on her face, Chynna continued, "I think my husband's a little desperate. It's been a while... I've been busy."

The "DWTS" Results

The Wilson Phillips singer forgot some of the steps during her performance on Monday's star-studded show, in which Cher was in the audience cheering for son Chaz. The supportive mom applauded wildly from her seat -- tweeting that she broke her bracelet from clapping so much. "Extra's" Renee Bargh informed Bono of his mom's broken bracelet during a backstage chat, and Chaz replied, "Aw, that's so awesome!"

Cher, who clearly enjoyed Chaz's performance, later tweeted that she might make another appearance on the reality show.

Despite negative reviews, people were curious to see Tim Allen's new sitcom. Last Man Standing debuted to 12.95 million viewers and nabbed a 3.5 rating among industry-prized 18-to-49-year-olds, overnight Nielsen ratings showed.

ABC sounded happy afterward, noting that the show achieved the network's highest demo rating in the Tuesday at 8/7c time slot in nearly two years.
